The Federal Authority for Identity, Citizenship, Customs and Ports Security (ICP) has recently provided updates on fines and regulations related to overstaying in the UAE due to delayed visa or residence permit renewals. This detailed clarification emphasizes the importance of adhering to the renewal deadlines to avoid legal and financial repercussions.

No Changes in Overstay Fines, ICP Confirms

The ICP has reiterated that the fines for overstaying due to delays in visa or residence permit renewals remain unchanged.

The authority’s latest announcement aims to clear up any confusion regarding penalties for failing to renew residence visas within the stipulated timeframe.

Renewal Process and Legal Obligations

According to the ICP, once a residence visa in the UAE expires, it is the sponsor’s responsibility to renew it promptly. Delays in renewal can lead to fines or other legal consequences. To avoid these penalties, the sponsor must complete the renewal process within the designated period.

Grace Period and Updated Fine Structure

30-Day Grace Period

The General Directorate of Residency and Foreigners Affairs (GDRFA) provides a 30-day grace period following the cancellation of residency in the UAE. This period is crucial for sponsors and residents to arrange renewals without incurring fines.

Increased Penalties for Residency Overstays

Violations of the residency period now incur higher fines:

  • First Six Months (180 days): AED 25 per day
  • Next Six Months: AED 50 per day
  • Beyond One Year: AED 100 per day

Visit Visa Fines and Application Procedures

Reduced Visit Visa Fines

The fine for overstaying on a visit visa has been reduced from AED 100 to AED 50 per day. The payment process depends on the duration of the overstay:

  • Under 30 Days: Fines can be paid at Dubai airports or the GDRFA main office.
  • Over 30 Days: Payment must be made directly at the GDRFA.

Application Process for Violators

If an application to renew a visa is returned due to incomplete data and is not resubmitted on the same day, the violator will face additional fines based on the number of days elapsed since the resubmission. Applications will be cancelled electronically after 30 days if they are repeatedly returned due to missing information or documentation.

Importance of Timely Renewal

When a visa expires, the corresponding Emirates ID also becomes invalid. Residents must renew their ID cards before applying for visa renewal to ensure compliance and avoid delays in processing.

Conclusion

The ICP’s clarification underscores the importance of adhering to the stipulated timelines for visa renewals to avoid fines and legal issues. Residents and sponsors must stay informed about the renewal processes and penalties to ensure smooth compliance with UAE residency regulations.
